Welcome to StackWise. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms apply to all visitors, users, and others who access or use our services. We reserve the right to modify these Terms at any time, and your continued use of our services constitutes acceptance of any modifications.

StackWise provides professional IT services including but not limited to:

  • Cloud Architecture & Migration
  • AI & Machine Learning Solutions
  • Software Engineering & Development
  • Data Ecosystems & Analytics
  • Digital Strategy Consulting

The specific scope, deliverables, and terms of any engagement will be defined in separate service agreements or statements of work.

3. User Responsibilities

By using our services, you agree to:

  • Provide accurate and complete information when requested
  • Use our services only for lawful purposes
  • Not interfere with or disrupt our services or servers
  • Not attempt to gain unauthorized access to any part of our systems
  • Not use our services to transmit harmful or malicious code
  • Comply with all applicable laws and regulations

4. Intellectual Property Rights

4.1 Our Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of StackWise or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

4.2 Client Work Product

Unless otherwise specified in a written agreement, upon full payment for services, clients receive ownership of the custom work product developed specifically for them. Pre-existing materials, frameworks, and tools used in development remain the property of StackWise.

5. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the course of any engagement. This includes business strategies, technical specifications, and any other information marked as confidential or that would reasonably be considered confidential.

6. Payment Terms

Payment terms for our services are specified in individual service agreements. Unless otherwise stated:

  • Payments are due within 30 days of invoice date
  • All fees are quoted and payable in the agreed currency
  • Late payments may incur interest charges
  • Prices are exclusive of applicable taxes unless stated otherwise

7. Limitation of Liability

To the maximum extent permitted by law, StackWise shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use our services
  • Any unauthorized access to or alteration of your data
  • Statements or conduct of any third party on our services
  • Any other matter relating to our services

Our total liability for any claim arising from these Terms or our services shall not exceed the fees paid by you for the specific service giving rise to the claim in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless StackWise and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services or violation of these Terms.

9. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use our services will immediately cease.

10. Warranties and Disclaimers

Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that our services will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with any applicable service agreements, constitute the entire agreement between you and StackWise regarding the use of our services and supersede any prior agreements between you and StackWise relating to the same subject matter.
